
Dhaka, Feb 8 (UNB) - The Appellate Division of the Supreme Court on Monday stayed for six weeks the operation of the High Court ruling declaring illegal the Warrant of Precedence in the state hierarchy.
Chamber judge M Muzammel Hossain, upon a petition moved by Attorney General Mahbubey Alam, passed the interim stay order and asked the government to file application in the meantime for leave-to-appeal against the High Court judgment.
On February 4, the High Court, upon a Public Interest Litigation (PIL) writ petition filed by a district judge, declared illegal the revised Warrant of Precedence (WoP) and ordered reshuffling the state hierarchy with constitutional post-holders and district judges placed above the military chiefs and the top government bureaucrats.
The HC had also directed the Cabinet Secretary to prepare the draft of a new Warrant of Precedence within 60 days in compliance with its 8-point guideline and submit it before the court for scrutiny.
The Warrant of Precedence is an enforceable law which is generally used for the purpose of invitation of dignitaries to state and other important official functions, and in general to determine protocol.
