
Dhaka, Feb 10 (UNB) - The fate of the unauthorized construction of top four floors of the massive 10-storied Jamuna Future Park shopping complex in the capital will be decided by the Appellate Division of the Supreme Court on Thursday.
After hearing a petition filed by Jamuna Builders Ltd seeking stay on a High Court verdict, a six-member Appellate Division bench on Wednesday fixed tomorrow (Thursday) for order.
The stay was sought on operation of the High Court verdict that gave legitimacy to Rajuk notice asking Jamuna Builders to dismantle the top four floors of the shopping complex built without approval.
The petition for stay was filed as Jamuna Builders prefers leave-to-appeal against the High Court verdict.
The Rajuk (Rajdhani Unnayan Kartripakkha) notice stands valid as the High Court on February 3 summarily rejected the owners’ writ petition challenging its legality.
A day after the High Court verdict Rajuk on February 4 started demolishing the unauthorized part of the shopping complex and later the operation was put off.
On January 13, Rajuk had served the notice asking Jamuna Builders tear down the unauthorized top four floors of the Jamuna Future Park shopping complex within seven days, as it only got approval for constructing a six-storey building but built more floors on top violating the rules.
Barrister Rafique-ul Huq appeared for Jamuna Builders Ltd while Attorney General Mahbubey Alam and advocate AFM Mesbahuddin stood for government and Rajuk respectively.
