
Dhaka, Mar 25 (UNB)-The government Thursday announced a 3-member tribunal headed by Justice Nizamul Huq, a judge of the High Court Division, to try perpetrators committed crimes against humanity during Bangladesh War of Liberation in 1971.
Two other members are: Justice ATM Fazle Kabir of the High Court Division and retired District Judge AKM Zahir Ahmed.
Law Minister Barrister Shafique Ahmed announced the names of the tribunal chairman and members, investigation agency and state prosecutors under Section-6 of the International Crimes (Tribunals) Act, 1973 at a news conference at the Home Ministry.
After long 39 years of the independence, Prime Minister Sheikh Hasina’s government finally initiated the legal move to try the criminals, who committed crimes against humanity through killing,
rape, loot and arson during the Liberation War.
Three million people were killed and two million women were raped by Pakistani occupation army in collaboration with the local lackeys.
In the first session of the present parliament, a resolution was passed with one voice to hold the trial of the war criminals. This was one of the major election pledge of the ruling Awami League.
The Law Minister said the chairman and the members of the tribunal will get remuneration and privileges of a High Court judge.
The Law Minister also announced the names of seven-member investigation agency and 12 state prosecutors under relevant sections of the International Crimes (Tribunals) Act, 1973.
Members of the Investigation Agency: Abdul Matin (Ex-Addl Secretary), Abdur Rahim (Ex-Addl IGP), Kutubur Rahman (Ex-DIG), Maj (retd) ASM Shamsul Arefin, Mir Shahidul Islam (Addl DIG (CID), Nurul Islam (Inspector CID, Dhaka Dist) and M Abdur Razzak Khan (Inspector CID).
The Law Minister said the members of the investigation agency will assist state prosecutors during the trial.
He named Adv Golam Arif Tipu as Chief Prosecutor. Other prosecutors are: Adv Syed Rezaur Rahman, Adv Golam Hasnayen, Adv Rana Das Gupta, Adv Zahirul Huq, Adv Nurul Islam Sujan, Adv Syed Haider Ali, Adv Khandaker Abdul Mannan, Adv Mosharraf Hossain Kajal, Adv Ziad Al-Malum, Adv Sanjida Khanom and Adv Sultan Mahmud Semon.
The Law Minister said if more prosecutors needed, will be appointed.
The tribunal, investigation agency and prosecutors were announced a day before the 40th anniversary of National Independence Day.
Barrister Shafique said the tribunal has been set up in consultation with the Chief Justice. The matter was also discussed with the President and the Prime Minister.
In reply to a question, he said the investigation agency will start work with the publication of the gazette notification today.
The Law Minister said with the permission of the tribunal, a person could be arrested and property seized in the interest of investigation.
He said it would take time to complete the investigation as evidence and documents will have to be collected from both at home and abroad.
Barrister Shafique said the trial will begin on completion of the investigation. However, he said if any specific evidence of committing offence against person could be found, the trial and investigation will continue simultaneously.
