Dhaka, Feb 23 (UNB) - Former ameer of Jamaat-e-Islami Ghulam Azam facing charges of crimes against humanity during the Liberation War failed to secure bail once again from the International Crimes Tribunal on Thursday as he could not place any new ground in support of his plea.

Rejecting the application for bail, Justice M Nizamul Huq, chairman of the three-member tribunal said, “We don’t find any new material in support of his plea.”

Old age health complications are not grounds that could be considered for bail, said Justice Huq, referring to Egyptian deposed president Hosne Mubarak, a cancer patient, who is also facing charges of crimes against humanity. Besides, the accused is now undergoing treatment at the prison cell of Bangabandhu Sheikh Mujib Medical University Hospital (BSMMUH), a top public hospital in the country, he added.

At this stage, the tribunal order said, the bail prayer cannot be considered as it had already taken cognisance of the charges against the accused and the charge hearing is going on.

On January 11, 89-year-old Ghulam Azam appearing in the dock on court’s order was sent to Dhaka Central Jail after the tribunal rejected his bail prayer. Later, he was taken back to the prison cell at BSMMUH for medical check-up. Since then, he has been kept there.

On January 9, the tribunal took cognisance of charges against the former Jammat chief.

The charges of crimes against humanity against Ghulam Azam fall under sections 3(2), 4(1) and 4(2) of International Crimes (Tribunals) Act 1973 that include killing, genocide, loot, rape and arson in collaboration with Rajakar, peace committees, Al Badr and Al Shams, the auxiliary forces of Pakistan junta.

Meanwhile, the scheduled deposition of prosecution witness 28 against detained Jamaat leader Delwar Hossain Sayedee, who faces trial of war crime charges, could not take place as the prosecution failed to produce the PW.

Following a time petition moved by the prosecution, the tribunal set arch 4 the next date of giving evidence of the new PW.

On the other hand, the tribunal following a time petition moved by a defence counsel re-fixed March 11 the next date for charge hearing against detained accused Jamaat secretary general Ali Ahsan M Mujahid.
