
Dhaka, May 21 (UNB) – A court here on Monday indicted BNP acting secretary general Mirza Fakhrul Islam Alamgir and 44 leaders of the 18-party alliance in a vehicle torching case.
Metropolitan Magistrate Mohammad Erfanullah passed the order in the afternoon.
Meanwhile, the same court sent BNP MP Barrister Mahbub Uddin Khokon to jail after he surrendered before it seeking expansion of his bail period in the case.
The lower court also issued a warrant for the arrest of four other alliance leaders, including Jamaat-e-Islami acting ameer Maqbul Ahmad, as they did not surrender before it as per a High Court order.
The three other warranted accused are Jamaat-e-Islami assistant secretary general Nurul Islam Bulbul, Islami Chhatra Shibir secretary general Delwar Hossain Sayedee and Jatiyatabadi Chhatra Dal’s Dhaka University unit joint secretary Obaidul Haque Nasir.
Earlier, on May 13, the court fixed today (Monday) to decide whether the opposition alliance leaders and activists would be indicted in the case filed for torching a bus near the Prime Minister’s Office during hartal on April 29.
After hearing both sides, the court today accepted the bus torching charges against the 45 opposition leaders. Barrister Mahbub Uddin Khokon, whose bail period ended on Sunday, was the only accused present during the hearing.
Later, the court sent Khokon to jail rejecting his bail extension plea.
As the court denied bail to the BNP MP, pro-BNP lawyers burst into protest and brought out a procession on the court premises. They also shouted anti-Awami League and anti-government slogans.
Meanwhile, Noakhali BNP called a dawn-to-dusk hartal in the district for Tuesday protesting the sending of Khokon to jail by the court.
Soon after the court order, BNP leaders and activists took to the streets at Sonaimuri upazila, the constituency of Khokon, and held a rally at the upazila headquarters protesting the court order.
They also put up barricade on Sonaimuri-Chatkhil road at about 1:30pm and vandalised at least six buses, four trucks and two CNG-run auto rickshaws, disrupting traffic for an hour.
On May 10, inspector of the Detective Branch of police Nurul Amin, also the investigation officer of the case, submitted the charge sheet against 45 leaders and activists of the BNP-led 18-party alliance, including Fakhrul, in the case.
The charge-sheeted accused also include BNP leaders Dr Khandker Mosharraf Hossain, MK Anwar, Hannan Shah, Mirza Abbas, Goyeshwar Chandra Roy, Ruhul Kabir Rizvi, Amanullah Aman, Mahbub Uddin Khokon and Fazlul Haque Milon, Jatiyatabadi Swechchhasebak Dal president Habib-un-Nabi Khan Sohel, Jatiyatabadi Chhatra Dal president Sultan Salahuddin Tuku and Liberal Democratic Party president Col (retd) Oli Ahmad.
Earlier, police arrested BNP joint secretary general Ruhul Kabir Rizvi, central committee member Kamruzzaman Ratan and five others in the same case.
On, May 16, 33 key leaders of the BNP-led 18-party alliances, including BNP acting secretary general Mirza Fakhrul Islam Alamgir, surrendered before the court complying with the order of a third bench of the High Court and submitted separate petitions seeking bails. However, the court sent them sent to jail rejecting their bail petitions.
Background
The 18-Party alliance enforced countrywide general strike on Apr 29 and 30 protesting the disappearance of BNP leader M Ilias Ali and his driver. A vehicle was torched near the PMO and crude bombs were hurled at the Secretariat compound during the hartal hours on April 29.
Tejgaon police filed a case against 45 leaders and activists of the BNP-led 18-party alliance for torching a vehicle near the PMO on the night of April 29.
On the same day, Shahbagh police lodged another case against 28 opposition leaders in connection with the bomb blasts at the Secretariat, making Mirza Fakhrul the main accused.
Later, the vehicle torching case was shifted to the DB police.
On May 7, when pro-BNP lawyers moved to the HC seeking bail for the accused, presiding judge Moyeenul Islam Chowdhury granted all the accused, including BNP acting secretary general Mirza Fakhrul Islam Alamgir, anticipatory bails till submission of police reports in the two cases, and issued a rule upon the government to explain as to why the accused should not be granted regular bails.
Differing with the presiding judge’s order, co-judge M Nazrul Islam Talukder asked all the accused-petitioners to surrender before the trial court for bails within a week and also asked the police not to harass them until then.
On May 10, Chief Justice M Muzammel Hossain sent the bail petitions of the opposition alliance leaders to the third bench of the High Court since two judges of a division bench earlier passed split orders on the petitions.
On May 14, the third bench of the High Court ordered the opposition leaders to surrender before the trial court by May 16 in the case. The one-judge bench of Justice Mohammad Anwarul Haq passed the order in the afternoon.
The bench also granted ad-interim bail to the 18-party alliance leaders till submission of the police report in another case filed for hurling bombs at the Secretariat during hartal on April 29.
